A REG question from the sample
An individual files her return and pays the $10,000 balance due exactly 3 months late. There is no reasonable cause and no fraud. What is the total addition to tax under IRC §6651 for the combined failure to file and failure to pay?

The answer is C. IRC §6651(a)(1) imposes a failure-to-file penalty of 5% of the unpaid tax per month (max 25%), and §6651(a)(2) imposes a failure-to-pay penalty of 0.5% per month (max 25%). For any month both apply, §6651(c)(1) reduces the failure-to-file penalty by the failure-to-pay penalty, so the net failure-to-file rate is 4.5% per month. Here: failure-to-file = 4.5% x 3 = 13.5% = $1,350; failure-to-pay = 0.5% x 3 = 1.5% = $150; total = $1,500 (15% of $10,000). The question is cited to IRC §6651.
